FYJC Bylaws

ARTICLE I: NAME

These articles shall be the By-Laws of the First Year Judiciary Committee of the University of Virginia, Charlottesville, Virginia.

ARTICLE II: AUTHORITY

A. The First Year Judiciary Committee is empowered to exercise all original jurisdiction specified in Article II, section A of the Constitution of the First Year Judiciary Committee.

B. The First Year Judiciary Committee shall have no appellate jurisdiction.

C. All proceedings before the Committee shall remain fully autonomous from all criminal and civil hearings.  For that reason, neither a criminal conviction nor arrest shall be required for or necessarily relevant to a University Judiciary Committee trial.  Also, criminal standards of evidence shall not take precedence over the Committee's standards at any point during the UJC process.  Scheduling shall also occur independent of any existing or potential legal action, civil or criminal.  The Executive Committee shall have the sole discretion to admit evidence pertaining to criminal and civil hearings.

ARTICLE III: QUALIFICATIONS FOR MEMBERSHIP AND RESPONSIBILITIES OF MEMBERS

A. The First Year Judiciary Committee shall be composed of the representatives selected as specified in Article V of the First Year Judiciary Committee Constitution. The newly selected Committee shall assume office following confirmation by the Chairperson of the University Judiciary Committee, at which point the outgoing First Year Committee ceases to serve. Each committee shall adjudicate first year cases involving incidents that occur from the start of the fall semester in which they were appointed until the end of the following spring semester. During the period between the elections and the beginning of their term, the new First Year Committee shall meet informally and elect its officers according to the Constitution.

B. Each member shall fulfill all duties required of him/her by the Chair of the University Judiciary Committee, the Vice-Chair for First Years of the University Judiciary Committee, and the Constitution and By-Laws of the University Judiciary Committee and the First Year Judiciary Committee.

  1. Judges are expected to attend all meetings of the University Judiciary Committee.
  2. Judges are expected to sign up for one third of the scheduled trials throughout the duration of his/her term.
  3. Judges may not discuss any details concerning any cases with anyone but the appropriate University Judiciary Committee personnel.

ARTICLE IV: ORGANIZATION

A. The elected Chairperson and Vice Chairperson of the First Year Judiciary Committee shall chair First Year Judiciary Committee Trials and complete administrative work for the committee.  They shall hold non-voting positions on the UJC executive committee and represent the First-Year Judiciary Committee with appropriate UJC members.

ARTICLE V: SUPPORT OFFICERS

The First Year Judiciary Committee shall use the same Senior Support Officers and Support Officers of the University Judiciary Committee.

ARTICLE VI: TRIAL PROCEDURES

The First Year Judiciary Committee shall use the same trial procedures as the University Judiciary Committee as explained in Article VI of the University Judiciary Committee By-Laws.

ARTICLE VII: SANCTIONS

All rules and regulations set forth by the By-Laws of the University Judiciary Committee with regards to sanctions shall be used by the First Year Judiciary Committee.

ARTICLE VIII: APPELLATE HEARINGS

Verdicts and sanctions determined by the First Year Judiciary Committee shall be appealed in the manner as set forth in Article VIII of the By-Laws of the University Judiciary Committee.

ARTICLE IX: SPECIAL PROCEDURES

Pursuant to Article II, section D of the First Year Judiciary Committee Constitution, the First Year Judiciary Committee shall not have jurisdiction over cases involving special procedures defined in Article IX of the UJC By-Laws.  Cases involving special procedures shall instead be forwarded to the University Judiciary Committee.

ARTICLE X: RATIFICATION AND AMENDMENT

These articles may be ratified by a two-thirds vote of the University Judiciary Committee.  As the By-Laws of the University Judiciary Committee are changed, these By-Laws shall change as necessary.
